SG 2018, Part D, question 2

1. You can download the QE2018 Paper D answer guidelines and overall comments in a zip file under this link: https://www.ipos.gov.sg/docs/default-source/default-document-library/qualifying-examination-2018.zip?sfvrsn=0

2. I provided the following answers to question 2:

Answer Q2, part 1

3. Examiners comments: "Key issues not spotted for (a) and please brush up on the principles of patent infringement."

4. Any comments which key issues I did not spot in (a)? Principles of patent infringement: isn't patent infringement already defined by SGPA s66 ("meaning of patent infringement") read in conjunction with SGPA s113 ("extent of invention") and in the light of decisions on purposive claim construction such as Bean Innovations and Durolock? One thing I noted that I got a little confused w the Improver questions, of course the answers should be no/yes/no, as stated in the answer guidelines, instead of all negative, which is self-evident if you read the Improver questions.
