Unveiling the Program for The Radical Robot Patent Drafting Workshop on May 13, 2023

The workshop is coming closer, only 3 days left.

Here is an outline of what we are going to do.

The workshop will not be like a conventional seminar. It is called a “workshop” because the participants are going to work.

Training Seat vs. Observer Seat

In the center are the “training seat” participants.

Only training seat participants have the following features:

  • Try and test the robot for yourself

We will use the available patent drafting robots for these purposes.

The workshop is intended to be a practical event where the robot manufacturers and the “training seat” participants are playing with what is there until these “training seat” participants are satisfied. If that state of satisfaction cannot be achieved on the same day, I will work with these “training seat” participants for free on another day, until they can draft their own patent application. If that still does not work then we pay their money back.

What Will Be Done During The Workshop

We will essentially do what the training seat participants say. In other words: the manufacturers will demonstrate their robots with the input data provided below, but according to the preference of the training seat participants.

If the training seat participants do not tell the manufacturers what they want to see, I will do so on their behalf. This is why I have provided the standard cases mentioned below, namely four (4) different starting points for patent drafting:

  1. Invention disclosure (no claims)
    a) No figures, no reference numerals, only text
    b) Figures + text, but no reference numerals
    c) Figures + text + reference numerals
  2. Claims
    a) No figures
    b) Claims + figures
  3. Claims + invention disclosure
  4. Old patent application + add-on paragraph + add-on figure

In other words, the event will be like a big sandbox game. As sandboxes can become chaotic after some time, we will re-start the process fresh at the beginning of each time slot. The manufacturers are there, and they will come in as it is appropriate.

 

US-Style vs. Non-US-Style Patent Drafting

The patent world falls into two major sections, with a Great Chasm fixed between them: US-style patents and non-US-style patents. We will discuss in detail what that means for drafting patent applications.

As a consequence of that, the below-mentioned time slots are governed by US-style patent drafting and non-US-style patent drafting.

Because of the time difference between the US and Asia, this is how we provide the time slots:

We have 6 manufacturers for 6 time slots, and there are no fixed time slots. But one thing is sure: once one manufacturer started to present at one time slot, the same manufacturer will not start again in another time slot, except that there is no other manufacturer left.

 

Lessons Presented During The Workshop

  • Patent Drafting Variants and Robot Patent Drafting, at the beginning of Slot 2.

And we will have an expert discussion about the differences between US-style patents and non-US-style patents, at the beginning of Slot 5.

Further short talks are planned for the beginning of the other slots 1 and 4.

Update of 27th of April 2023:

We have six (6) time slots in our workshop and the question came up which manufacturer will be at what time slot.

The answer is simple: there will not be a fixed schedule for manufacturers because this is an interactive workshop and the participants say what they want to see.

There will be sessions that are prepared, such as a discussion about what the different requirements for US and non-US litigation grade patents are, but they will be filled in between practice sessions, as they occur. We will do one example for one starting point (see below) with both US and non-US litigation grade styles so that you can see yourself how different the tools behave in that context.

The sessions have defined starting times so that it is easier for all to synchronize. At each start time of each session, a new guided demonstration takes place.

We will take you by the hand and show you the following steps, one by one, for each one of the available patent drafting robots, and for each one of the seven (7) use cases mentioned below.

Step #1: Understand Yourself

As with many things in life, it all starts with understanding yourself. Are you a difficult character, who is not open to new tools and solutions? Or are you willing to compromise on the specific language style of your patent applications, as long as the content is good? We will bring you in situations where you can find that out if you do not yet know that about yourself.

Step #2: Find Your Personal Use Case for Your Patent Drafting Robot

Patent Drafting Robots come in many variations, and not every drafting robot can be easily used for every use case. We give you several typical use cases, and we help you to prepare a number of examples that you can use with the several Patent Drafting Robots that we have ready for you. Is the result good enough for what you expect? We show you how to use the same sample input data for each test to check which Patent Drafting Robot works best for you.

Step #3: What Is Your Preferred Data Security Standard and Your Preferred Way of Communicating With the Patent Drafting Robot?

We will show the different variants at the workshop: Patent Drafting Robots that are running on the cloud, or Patent Drafting Robots to which you have to send your input data via email. And you can discuss data security matters with the manufacturers.

Step #4: Is Your Expected Gain in Speed Really Worth the Effort To Overcome the Learning Curve That Comes With It?

That one is brutal: we will help you to find out whether you will really gain so much from using a Patent Drafting Robot that it is worth spending the time learning how to do so. You can discuss that with experienced users of patent drafting robots.

Step #5: Are You a Juicy Target for a Patent Drafting Robot Manufacturer?

You can use the workshop for finding out what your overall potential for using a Patent Drafting Robot is. If you are not a juicy business case for a manufacturer, we will be there for you and make sure that you still can use a Patent Drafting Robot. We make sure that there is no disappointment.

Step #6: Are You in a Position To Command the Use of a Patent Drafting Robot in Your Own Work Environment?

While you may be in a position that theoretically allows you to determine whether or not your subordinates have to use a Patent Drafting Robot, this might not help you. You can discuss with other experienced users how you can support your team in more easily adopting that new technology. There will be no recordings of the event because we want to make sure that the Training Seat participants can have their own space, without the fear of what they do will be published later.

We will not provide a White Book of the workshop event because everything that needed to be said is stated in my earlier RPD Manifesto (click here). What you need now is hands-on training with specialized software that is not ChatGPT.

What we will publish is the input data that has been used, plus the patent applications that were produced by the various users and their robots. Plus the working time that has been spent to produce these patent applications.

The Radical Robot Patent Drafting Workshop is designed to cater to participants from diverse technical backgrounds and varying levels of expertise. Program Schedule

The workshop is divided into six (6) time slots, starting from 9:00 AM Malaysia Time.

Drafting Styles

The workshop will cover both US and non-US drafting styles, with their respective characteristics:

US Drafting Style:

The following matters are important when drafting US patent applications:

  • Avoid mentioning advantages
  • Avoid defining the “invention”
  • Avoid reference numerals in the claims
  • Use a lot of “may” and other vague wordings
  • Include a “summary”

We will discuss these at the workshop.

Non-US Drafting Style:

The following matters are important when drafting non-US patent applications:

  • Intermediate generalizations
  • Advantages/technical effects required for using a claim element for arguing in favor of inventive step and against obviousness
  • Selection inventions

We will discuss these at the workshop.
